Title Search

Capital Abstract & Title provides full searches, updates, and continuation (post-closing) searches in accordance with Florida title standards. We use a combination of Capital Abstract & Title staff and Underwriter information to provide fast, efficient, & accurate title search services at competitive rates. The title search is not a guarantee of title. It is simply a summary of the recorded instruments that affect the title to the real estate.

Title Examination

A Title Examination is an analysis of the title search and the instruments contained therein (and sometimes other title evidence), assessing the correctness & sufficiency of the instruments to determine who owns the property, what outstanding mortgages, liens, unpaid taxes, and judgements against the Seller affect the title to the property, and any action required to pass good, marketable record title. Many title defects can not be discovered by the Title Examiner because they have never been recorded and therefore are not part of the Title Search. Title Insurance protects against that hidden risk and many others.

Title Insurance

Buying a home may be the biggest single financial transaction of your lifetime. A life's savings may be invested in this one venture. It makes sense to assume that you want to protect the proof of ownership of that investment. Title Insurance is the most effective and affordable means to protect the owner against future claims and the legal costs expended in defense of his interest in the real estate.

Typically, when you are buying, selling or refinancing real estate, you will be required to purchase title insurance. Title Insurance protects the owner and lender by providing insurance coverage against hidden defects in the title, errors in the public records, restrictions limiting the use of the property or encumbrances except as shown in the policy, and other risks that may affect their interest in the property.

The Owner's Policy protects the Owner's equity investment in the property, up to the amount of the purchase price. The Lender's Policy is issued to a Mortgage Lender and protects that Lender's interest in the property as security for the outstanding balance of the owner's mortgage. It does not insure the Owner. The premium for the Owner's Policy and/or Lender's Policy is a one-time charge paid at the time of closing. If an Owner's Policy is purchased at the same time as the Lender's Policy, the combined premiums are discounted. The premiums charged by all title insurance companies in Florida are regulated by the State of Florida , Department of Insurance.

Document Preparation

Capital Abstract & Title prepares all documents required to transfer marketable title from the Seller to the Buyer in accordance with the Contract for Sale and Purchase, including but not limited to Warranty Deeds, No Lien Affidavits, FIRPTA Affidavits, Bills of Sale, Non-Identity and Continuous Marriage Affidavits, and HUD-1 Settlement Statement.

Closing

Capital Abstract & Title provides on-site and off-site closing services for buyers, sellers, brokers and lenders. Services include preparation of settlement statement, review & execution of lender documents, preparation & execution of instruments of conveyance, post-closing transmittal of required loan documents, recording, escrow & disbursement of funds, and distribution of the documents.
